The Dean of the IBS, Assoc. Prof. Dr. Asmadi Mohamed Naim, said that hibah was one of the approaches to Islamic property planning that were crucial to obviating property disputes arising in the future.
According to Dr. Asmadi, specifically, hibah is a contract whereby the ownership of a piece of physical property (‘ain) is granted voluntarily by the hibah provider, during their lifetime, to another party without the imposition of a reprisal (iwad). In theory, hibah is one of the principles in Islamic Muamalat practised by Islamic financial institutions.
"Today, there are many institutions that manage family estates like Wasiyyah Shoppe Sdn Bhd, which has long practised the hibah method of management. However, the concept of hibah is still largely unknown to the people of this country because of the lack of promotion, as well as understanding, concerning it.
"As such, this inaugural seminar, which is organised in collaboration with Wasiyyah Shoppe Sdn Bhd, aims to discuss this concept and present it to the members of both the Muslim and non-Muslim communities in order to help them better understand the concept and put it into practice in their lives," he said.
He added that the two-day seminar would provide valuable information concerning hibah, which would help towards understandingits implementation.
Meanwhile, the CEO of Wasiyyah Shoppe, Mr. Azrin Sabirin, who is also the Co-Chairman of i-Hibah, said that, though this year’s seminar marked the fourth instance of its organisation, it was the first time that it was successfully organised in collaboration with UUM.
He said that hibah was only just beginning to gain exposure as the most effective estate planning instrument, particularly for Muslims. However, he added, the Muslim community was yet to gain a full understanding of the difference between hibah and the will.
"This seminar will provide a platform for all academics, practitioners i.e. the members of the Syariah Court, and industry players to analyse, discuss, and disseminate knowledge concerning the concept of hibah more effectively.
"Therefore, it is hoped that this seminar will impart beneficial knowledge to all participants, not only those from UUM and the northern region of the Peninsula, but also those from Brunei," he said.
The opening ceremony was officiated by Tuan Sheikh Ahmad Faisol Omar, the Chief Assistant Director of the Syariah Law Enforcement Division, Kedah Islamic Affairs Department.
The seminar participants will have the opportunity to hear the keynote address presented by the erudite Syariah Chief Judge of the Pahang SyariahJudiciary Department, Dato' Abdul Rahman Md Yunus. Apart from this, they will also be able to glean much gainful information furnished by the various parallel sessions scheduled to run throughout the seminar.
